Is a virtual office legal?

Yes, using virtual office services is legal and is slowly becoming a more and more common practice among representatives of the so-called free professions, start-ups and small companies working mainly online.

However, a few years ago, a discussion appeared on the Internet regarding the legal aspects of the activities of this type of offices. It did not concern institutional issues, only tax ones. There have been stories in which the Tax Office questioned the possibility of registering a business in this type of office and refused to assign a Tax Identification Number. The refusal was justified by the failure to indicate in the identification application the number of a specific premises in the building and the failure to perform management functions at the indicated address of the Company's registered office.

Tax Offices relatively quickly, in 2014, were quite firmly and radically disciplined by the Supreme Administrative Court, which in the quite famous case II FSK 3549/13 indicated that there are no regulations that would oblige the taxpayer to indicate premises with this type of properties, and, in addition, the Tax Office did not demonstrate in any way the grounds on which it concluded that, for example, management functions could not be performed at the indicated address. The Supreme Administrative Court dispelled all doubts by expressing open support for this type of activity, stating that:
